Terms of Service

Effective Date: November 7, 2025

Welcome to DNFT INC. These Terms of Service govern your access to and use of our websites, applications, messaging services, AI-powered features, and related software and documentation (collectively, the "Service"). By accessing or using the Service you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

1. Eligibility and Acceptance

1.1 Age Requirements.

You must be at least 13 years old to use the Service. Children under 13 are strictly prohibited from using the Service under any circumstances. If you are between 13 and 18 you may use the Service only with consent and supervision of a parent or legal guardian. We do not knowingly collect personal information from children under 13, and we will immediately terminate any account we discover belongs to a child under 13.

1.2 Organizational Use.

If you use the Service on behalf of an organization, you represent that you have authority to bind that organization.

1.3 Acceptance.

By using the Service you accept these Terms and our Privacy Policy. Continued use following updates to these Terms constitutes acceptance of the revised Terms.

2. The Service

2.1 AI-Powered Features.

DNFT provides AI-powered services including conversational assistants, messaging features, information retrieval, image generation, and other capabilities. Specific features may change at any time.

2.2 Group and Solo Conversations.

When you use our AI features in group conversations, messages and metadata in those conversations may be processed to operate the Service. You are responsible for ensuring that all participants consent to the presence of AI that can read messages and respond in conversations.

2.3 Availability.

The Service may experience delays, outages, or limitations. We may suspend, modify, or discontinue any feature at any time.

3. Accounts and Security

3.1 Registration.

Registration may be required for some features. You must provide accurate information and keep it current.

3.2 Account Security.

You are responsible for any activity that occurs under your account or contact information. Keep credentials secure and notify us promptly of unauthorized access.

3.3 Account Transfer.

You may not share, sell, or transfer your account. We may suspend or terminate accounts for suspected misuse or violations of these Terms.

4. Acceptable Use and Prohibitions

You agree that you will not:

  • Access or use the Service in violation of any law or regulation.
  • Probe, scan, or test the vulnerability of the Service.
  • Interfere with or disrupt the Service.
  • Use automated means to scrape or harvest data except as permitted by robots.txt for public pages.
  • Upload or transmit malware, spam, or unlawful, defamatory, or infringing content.
  • Impersonate others or misrepresent your affiliation.
  • Use the Service to create competing models or to extract datasets or outputs programmatically without our written consent.
  • Submit Sensitive Information. The Service is not designed for protected health information under HIPAA, government identifiers, financial account numbers, payment card data, or special categories of data under GDPR. Do not send such data through the Service.

4.5 Child Safety and Zero Tolerance Policy

DNFT INC maintains a zero-tolerance policy for child sexual exploitation and abuse. Child safety is foundational to everything we do.

A minor is defined as anyone under the age of 18 anywhere in the world.

4.5.1 Strictly Prohibited Activities

You are absolutely prohibited from:

Child Sexual Abuse Material (CSAM):

  • Creating, uploading, sharing, requesting, or distributing images, videos, or other visual depictions of minors engaged in sexually explicit conduct
  • Real photographs or videos of child sexual abuse
  • Computer-generated or AI-generated CSAM
  • Animated or drawn depictions (including cartoons, anime, or illustrations)
  • Fictional depictions or written content that sexualizes minors
  • Attempting to circumvent detection by using coded language, euphemisms, or technical workarounds

Grooming and Solicitation:

  • Attempting to establish relationships with minors for sexual purposes
  • Soliciting minors for sexual content, images, or meetings
  • Manipulating or coercing minors into sexual activity or content creation
  • Building trust with minors with intent to exploit ("grooming")
  • Requesting or offering to trade CSAM
  • Facilitating or coordinating exploitation of minors

Sexualization of Minors:

  • Creating content that sexualizes, fetishizes, or inappropriately depicts minors
  • Requesting AI-generated content involving minors in sexual or suggestive scenarios
  • Using the Service to roleplay scenarios involving sexual contact with minors
  • Creating "age-down" content that depicts adults as children in sexual contexts
  • Discussing sexual attraction to minors or advocating for adult-minor relationships

Other Harmful Content Involving Minors:

  • Facilitating child trafficking or exploitation
  • Providing information that could be used to harm, locate, or exploit specific minors
  • Sharing personal information about minors without parental consent
  • Encouraging minors to engage in dangerous, illegal, or self-harming activities
  • Bullying, harassing, or threatening minors

4.5.2 Detection and Prevention Systems

We employ multiple layers of technical protection:

Hash Matching:

  • We maintain databases of known CSAM using industry-standard hash technology (PhotoDNA, MD5, SHA-256)
  • Every image uploaded or generated is automatically checked against these databases
  • Matches trigger immediate blocking, account suspension, and reporting to NCMEC

Perceptual Hashing:

  • We use advanced perceptual hashing to detect CSAM that has been modified (cropped, filtered, resized)
  • This prevents circumvention through simple image manipulation

AI-Based Content Analysis:

  • Machine learning models analyze images for indicators of child exploitation
  • Semantic analysis of text conversations to detect grooming patterns, abusive behaviors, destructive content, and criminal activity
  • Behavioral pattern recognition to identify solicitation attempts
  • Age estimation technology to detect potential minors in content

Natural Language Processing:

  • Detection of coded language and euphemisms used by exploiters
  • Identification of concerning conversation patterns including grooming, abuse, threats, and other harmful behaviors
  • Recognition of manipulation, coercion, and destructive tactics
  • Flagging of inappropriate requests involving minors
  • Detection of criminal activity indicators

Prevention Measures:

  • Requests that attempt to generate harmful content involving minors are blocked before processing
  • AI models are instructed to refuse inappropriate requests
  • Multiple layers of content filtering prevent harmful outputs
  • Systems to identify when users may be minors with automatic enhanced protections

4.5.3 Consequences of Violations

Immediate Actions:

  • Instant termination of access to the Service without warning
  • Immediate deletion of violating content from active systems
  • Preservation of evidence in secure, access-controlled storage indefinitely
  • No refunds for paid subscriptions
  • Prevention of re-upload using hash databases

Reporting:

  • Within 24 hours we report to the National Center for Missing & Exploited Children (NCMEC) through the CyberTipline
  • Law enforcement is notified as appropriate
  • Safety consortium partners are alerted to prevent cross-platform abuse

Permanent Bans:

  • Phone numbers, email addresses, payment methods, and other identifiers are permanently banned
  • Attempts to create new accounts are automatically detected and blocked
  • Information may be shared with other platforms through safety coalitions to enable cross-platform bans
  • Zero-tolerance violations are not appealable

4.5.4 Reporting Child Safety Concerns

If you encounter concerning content or behavior on the Service:

  • High-priority reports reviewed within 1 hour
  • All other reports reviewed within 24 hours

Report Directly to Authorities:

  • NCMEC CyberTipline: www.cybertipline.org or 1-800-THE-LOST
  • 911 for imminent danger or emergency
  • FBI Internet Crime Complaint Center: IC3.gov

What to Include in Reports:

  • Description of the concern
  • Account identifiers or contact information involved
  • Screenshots or content examples (if safe to provide)
  • Dates and times
  • Any additional context

5. Your Content

5.1 Ownership.

You retain ownership of text, images, and other content you submit to the Service, called User Content.

5.2 License to DNFT INC.

You grant DNFT INC a worldwide, non-exclusive, royalty-free license to use, reproduce, host, store, modify, create derivative works of, display, and distribute your User Content as needed to operate, maintain, secure, and improve the Service, to comply with law, and to enforce our policies.

5.3 Group Responsibility.

If you submit User Content that includes information about other participants, you represent that you have the right to share that information with us for the purposes described in these Terms.

5.4 Content Moderation and Safety Systems.

We employ a combination of automated systems and human review to detect, prevent, and respond to violations of these Terms, particularly content that exploits or endangers minors.

We may, at any time and without notice:

  • Remove, disable access to, or refuse to process User Content that violates these Terms or law
  • Suspend or terminate accounts associated with violating content
  • Report violations to NCMEC, law enforcement, and other appropriate authorities
  • Preserve evidence of violations indefinitely for investigative and preventative purposes
  • Share information about violating accounts with other platforms and services through industry safety coalitions and information-sharing programs

Content that violates our child safety policies will be removed immediately and permanently. We maintain a hash database of known CSAM to prevent re-upload.

6. AI Output and Accuracy

6.1 Output.

The Service generates text and images, called Output. As between you and DNFT INC, and to the extent permitted by law, subject to these Terms, you may use Output for any lawful purpose. Output may not be unique and others may receive the same or similar Output.

6.2 No Human Authorship Claim.

Do not represent that Output was human generated when it was generated by an AI model.

6.3 Use at Your Own Risk.

Output can be incomplete, inaccurate, or offensive. Do not rely on Output as a sole source of truth or as a substitute for professional advice. You are responsible for evaluating Output before using or sharing it, including with human review where appropriate.

6.4 Prohibited Uses of Output.

Do not use Output to:

  • Make decisions that have legal or material impact on individuals, including decisions about employment, credit, housing, insurance, education, or health.
  • Create, share, or facilitate content that exploits, endangers, or sexualizes minors in any way, including fictional or AI-generated scenarios, roleplay, or creative content involving minors in inappropriate contexts.

7. Third Party Services and Model Providers

7.1 Providers.

The Service may send input and conversation context to third-party AI providers and infrastructure partners such as OpenAI, Anthropic, Google, Perplexity, and communications carriers. Use of those services is subject to their terms and policies. We are not responsible for third-party services or outages.

7.2 Integrations.

The Service may offer optional integrations with partners. Those integrations are subject to separate terms.

7.3 Links and Third Party Content.

Links or references do not imply endorsement.

8. Communications

8.1 Consent to Communications.

By providing contact information you consent to receive messages from us, including transactional messages about security, account changes, billing, product updates, and service alerts. Standard carrier rates may apply.

8.2 Opt-Out.

You may opt out of promotional communications at any time. You cannot opt out of essential transactional messages while you use the Service.

9. Privacy and Data Use

9.1 Privacy Policy.

Our Privacy Policy explains how we collect, use, and share information. By using the Service you consent to those practices.

9.2 Data Processing for Safety.

We may process messages, attachments, metadata, and conversation patterns to operate features such as memory, search, personalization, and critical safety functions including:

  • Detection of child sexual abuse material (CSAM) through hash matching, perceptual hashing, and AI-based content analysis
  • Identification of grooming patterns, solicitation attempts, and exploitation behaviors
  • Prevention of harmful content generation involving minors
  • Compliance with mandatory reporting obligations under federal and state law
  • Cooperation with law enforcement and NCMEC investigations
  • Sharing information with other platforms through safety consortiums to prevent cross-platform abuse

Safety-related processing may occur even for deleted content, and we may retain evidence of violations indefinitely to prevent repeat offenses, support investigations, and protect children.

9.3 Data Retention.

We retain information for as long as needed for the purposes described in our Privacy Policy and to comply with law. We may anonymize or aggregate data for analytics and service improvement.

10. Fees, Billing, and Trials

10.1 Pricing.

Some features are free. Paid plans renew automatically unless canceled in accordance with this Section.

10.2 Billing.

You authorize us and our payment processors to charge your payment method for applicable fees and taxes. If payment fails we may suspend or downgrade service.

10.3 Refunds.

Except where required by law, payments are non-refundable. We may, in our sole discretion, issue a courtesy credit for duplicate charges or verified technical errors.

10.4 Price Changes.

We may change prices at any time. Changes will apply on the next renewal.

10.5 Cancellation.

You can cancel through your account settings or by contacting support at support@dnftinc.com. Canceling stops future renewals and does not entitle you to a refund for the current term.

10.6 Free Trials.

If a free trial is offered you must cancel before the trial ends to avoid charges.

11. No Medical, Legal, or Professional Advice

The Service provides general information and productivity features. It does not provide medical, psychiatric, psychological, legal, financial, or other professional advice. You are solely responsible for your actions and outcomes.

Crisis Resources: If you are in distress or at risk of self-harm call your local emergency number. In the United States dial 988 for the Suicide and Crisis Lifeline.

12. Intellectual Property

12.1 DNFT Ownership.

DNFT INC owns all rights in the Service, including software, models, design, and trademarks. Except for the limited rights expressly granted in these Terms, no rights are transferred to you.

12.2 Use of Our Marks.

You may use our name and logos only in accordance with our published brand guidelines or with our prior written consent.

12.3 Reverse Engineering.

You may not reverse engineer, decompile, or attempt to derive source code or model parameters except where such restriction is prohibited by law.

13. Feedback

If you send suggestions or ideas you grant DNFT INC a perpetual, worldwide, irrevocable, royalty-free license to use them without restriction or obligation.

14. Termination

14.1 Voluntary Termination.

You may stop using the Service at any time.

14.2 Termination by DNFT.

We may suspend or terminate your access to the Service with or without notice for any reason, including violation of these Terms or risk to the Service or others.

14.3 Effect of Termination.

Upon termination your right to use the Service ends immediately. We may retain information as required by law or for legitimate business purposes such as security, fraud prevention, child safety, or dispute resolution.

15. Disclaimer of Warranties

The Service is provided as is and as available. To the fullest extent permitted by law, DNFT INC disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, non-infringement, and quiet enjoyment. We do not warrant that the Service will be uninterrupted, secure, or error-free, or that data will not be lost.

16. Limitation of Liability

To the maximum extent permitted by law, DNFT INC and its affiliates will not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, or any loss of profits, revenue, data, or goodwill arising from or related to your use of the Service. Our aggregate liability under these Terms will not exceed the greater of one hundred dollars ($100 USD) or the amount you paid for the Service that gave rise to the claim during the twelve months before the event giving rise to liability. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

17. Indemnification

You will indemnify and hold harmless DNFT INC and its officers, directors, employees, and agents from and against any claims, losses, liabilities, damages, costs, and expenses including reasonable attorneys' fees arising out of or related to your User Content, your use of the Service, or your violation of these Terms or applicable law.

18. Dispute Resolution and Arbitration

18.1 Informal Process.

Before filing a claim, you agree to email us at legal@dnftinc.com and attempt to resolve the dispute informally. If we cannot resolve it within 60 days either party may begin arbitration.

18.2 Arbitration.

Any dispute arising out of or relating to these Terms or the Service will be resolved through final and binding arbitration administered by National Arbitration and Mediation (NAM) under its applicable rules. The Federal Arbitration Act governs this agreement to arbitrate. The arbitration will be conducted by video conference when possible. If an in-person hearing is required, the location will be in the county of your residence if in the United States, or San Francisco, California, unless the arbitrator orders otherwise.

18.3 Class Action and Jury Trial Waiver.

Disputes must be brought only in an individual capacity. Class, consolidated, or representative proceedings are not allowed. You and DNFT INC waive the right to a jury trial.

18.4 Small Claims and Equitable Relief.

Either party may seek relief in small claims court for qualifying disputes or seek temporary or injunctive relief in court to protect intellectual property or data security.

18.5 Severability.

If any part of this Section is found unenforceable, the remainder will remain in effect, except that if the class waiver is found unenforceable, this entire Section will be unenforceable.

19. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict of law rules, except that the Federal Arbitration Act governs the arbitration agreement. Subject to the arbitration terms above, the exclusive venue for litigation that is permitted to proceed in court is San Francisco, California.

20. Export and Trade Controls

You must comply with all applicable export control and sanctions laws. The Service may not be used in or for the benefit of embargoed countries or restricted parties.

21. Copyright Complaints

If you believe content on the Service infringes your copyright, send a notice with the following information:

  • Your physical or electronic signature.
  • Identification of the copyrighted work.
  • Identification of the material claimed to be infringing and information sufficient to locate it.
  • Your contact information.
  • A statement of good faith belief that the use is not authorized.
  • A statement under penalty of perjury that the information in the notice is accurate and that you are the copyright owner or authorized agent.

22. Publicity

We may identify you or your organization by name and logo as a DNFT user in marketing materials. You can opt out by emailing support@dnftinc.com.

23. Changes to the Service or Terms

We may update the Service and these Terms from time to time. We may provide notice of changes by email or in-product notice, but are not required to do so. Your continued use of the Service after any changes constitutes acceptance of the revised Terms. If you do not agree to the changes you must stop using the Service.

24. Miscellaneous

24.1 Assignment.

You may not assign or transfer these Terms without our prior written consent. We may assign these Terms to an affiliate or in connection with a merger, acquisition, or sale of assets.

24.2 Entire Agreement.

These Terms plus any referenced policies form the entire agreement between you and DNFT INC regarding the Service.

24.3 Severability.

If any provision is held invalid, the remaining provisions will remain in full force and effect.

24.4 No Waiver.

A failure to enforce a provision is not a waiver of the right to enforce it later.

24.5 California Customers.
